Welcome to Bulletproof Test Prep. Please read these Terms of Service ("Terms") carefully before using our website and services.

1. Acceptance of Terms

By accessing or using Bulletproof Test Prep ("BTP," "we," "us," or "our"), including our website at bulletprooftestprep.com and any associated applications or services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website. Your continued use of our services after such changes constitutes acceptance of the new Terms.

You acknowledge that electronic submission of any BTP form or enrollment document constitutes a valid, binding acknowledgment with the same legal effect as a written signature.

2. Description of Services

Bulletproof Test Prep provides educational materials and practice questions designed to help users prepare for the National Home Inspector Examination (NHIE). Our services include:

• Practice questions and quizzes
• Study progress tracking
• Personalized study recommendations
• Practice examinations
• Performance analytics

Important: Our practice materials are designed to supplement your exam preparation. We do not guarantee that using our services will result in passing any examination. Exam content, format, and requirements are determined by the respective examination bodies and may change without notice.

3. Account Registration

To access certain features of our services, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access to your account

You must be at least 18 years old to create an account and use our services.

4. Payments and Access

Access to our study materials requires a one-time payment. By purchasing access to our services, you agree to:

• Pay all applicable fees as described at the time of purchase
• Provide valid payment information
• Authorize us to charge your payment method for the applicable access fee

Users accessing BTP services through a promotional access code provided by a Partner school or institution are subject to Section 4A of these Terms in lieu of the payment requirements in this section.

All payments are processed securely through Stripe. We do not store your complete payment card information.

Refund Policy

Due to the digital nature of our services and immediate access to content upon purchase, all sales are final. Refunds may be considered on a case-by-case basis for technical issues that prevent access to the service. Please contact us at support@bulletprooftestprep.com for any billing concerns.

4A. Access Codes and Promotional Access

4A.1 Eligibility.

Some users may access BTP services through a promotional access code provided in connection with a school, institution, or organization that has entered into a separate agreement with BTP (a "Partner"). To receive an access code, you must complete and submit BTP's student enrollment form, which includes required data sharing and contact authorization disclosures. Submission of the enrollment form is a condition of receiving and activating any access code. BTP will not distribute an access code until it has received a conforming enrollment form submission from the requesting student.

4A.2 Non-Transferability.

Access codes are issued to individual users and are non-transferable. You may not share, sell, assign, or otherwise transfer your access code to any other person. Use of an access code by any person other than the individual to whom it was issued is a violation of these Terms and may result in immediate deactivation of the code without notice.

4A.3 Limited Access Period.

Access codes provide access to BTP services for a limited period as specified at the time of issuance. BTP reserves the right to modify or terminate promotional access at any time, including upon expiration or termination of the applicable Partner agreement. BTP will make reasonable efforts to provide advance notice of access termination but is not obligated to do so.

4A.4 No Monetary Value.

Access codes have no monetary value and may not be redeemed for cash, credit, or any substitute benefit. No refunds or credits will be issued for unused portions of a promotional access period.

4A.5 Conversion to Paid Access.

Upon expiration of your promotional access period, continued access to BTP services requires purchasing access under Section 4 of these Terms. BTP may, but is not obligated to, notify you prior to expiration of your promotional access period.

4A.6 Data Collection and Use.

By submitting the student enrollment form and using BTP services under a promotional access code, you acknowledge and agree that BTP may collect, retain, and use your account data and platform usage data as described in our Privacy Policy and consistent with the authorizations you provided in your enrollment form. BTP may use aggregated, anonymized outcome data for marketing, research, and promotional purposes without further consent, including identifying your Partner school by name in aggregated outcome statements. BTP will not publicly disclose your personally identifiable information without your consent, except as required by law.

4A.7 Relationship with Partner Schools.

The terms of your Partner's agreement with BTP govern BTP's relationship with that Partner. BTP is not responsible for any representations made by your Partner regarding BTP services, access duration, or outcomes. BTP's obligations run to you as an individual user, not through your Partner.

4B. Money Back Guarantee

BTP offers an optional Money Back Guarantee ("MBG") available exclusively to eligible direct purchasers. The MBG is not available to users who access the platform through an access code provided by a school, organization, or any third party.

To qualify for a refund under the MBG, you must: (a) register for the MBG through the BTP platform prior to taking the NHIE; (b) complete at least five full-length practice exams within the platform with a passing score of 75% or higher on each; (c) take the NHIE within 30 days of your last qualifying full-length practice exam; and (d) fail the NHIE on your first attempt. Refund requests must be submitted in accordance with the procedures set forth in the Money Back Guarantee Agreement.

The MBG refund constitutes your sole and exclusive remedy for any claim arising from or relating to your failure to pass the NHIE. The MBG is governed by additional terms and conditions set forth in BTP's Money Back Guarantee Agreement, which is available upon request.

5. Acceptable Use

When using our services, you agree NOT to:

• Share your account credentials with others
• Share, sell, assign, or transfer your access code to any other person
• Copy, reproduce, distribute, or publicly display our content
• Use automated systems or bots to access our services
• Attempt to reverse engineer or decompile our software
• Circumvent any access restrictions or security measures
• Use our services for any unlawful purpose
• Interfere with or disrupt our services or servers
• Impersonate any person or entity
• Collect or harvest user information without consent

Violation of these terms may result in immediate termination of your account without refund.

6. Intellectual Property

All content on our platform, including but not limited to text, questions, images, graphics, software, and design elements, is owned by Bulletproof Test Prep or its licensors and is protected by copyright, trademark, and other intellectual property laws.

Your purchase of access grants you a limited, non-exclusive, non-transferable license to access and use our content solely for your personal, non-commercial exam preparation purposes. This license does not include the right to:

• Reproduce or copy our content for distribution
• Modify or create derivative works
• Use our content for commercial purposes
• Remove or alter any proprietary notices

7. Disclaimers

No Guarantee of Exam Results: Our services are study aids only. We make no guarantees, representations, or warranties regarding your performance on any examination. Success on examinations depends on many factors beyond our control.

Content Accuracy: While we strive to provide accurate and up-to-date information, exam requirements and content may change. We recommend verifying current examination requirements with the appropriate licensing authorities.

"As Is" Service: Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

8. Limitation of Liability

To the maximum extent permitted by law, Bulletproof Test Prep and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or goodwill
• Service interruption or computer damage
• Cost of substitute services
• Failure to pass any examination
• Any matter beyond our reasonable control

Our total liability for any claims arising from your use of our services shall not exceed two hundred dollars ($200.00). For users accessing services at no charge through a promotional access code, BTP's total liability for any claim shall not exceed fifty dollars ($50.00).

9. Indemnification

You agree to indemnify, defend, and hold harmless Bulletproof Test Prep and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in connection with:

• Your use of our services
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit or transmit through our services

10. Termination

We reserve the right to suspend or terminate your account and access to our services at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• Extended periods of inactivity
• Request by law enforcement or government agencies

Access codes issued in connection with a Partner agreement may also be deactivated upon expiration or termination of that Partner agreement.

Upon termination, your right to use our services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Except as otherwise provided in Section 12, any disputes arising from these Terms or your use of our services shall be resolved in the state or federal courts located in Harris County, Texas.

12. Dispute Resolution

12.1 Informal Resolution.

Before initiating any legal action, you agree to first contact us at support@bulletprooftestprep.com to attempt to resolve any dispute informally. We will make reasonable efforts to resolve disputes within 30 days of receiving your notice.

12.2 Class Action Waiver.

YOU AND BTP AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. If this class action waiver is found unenforceable with respect to any claim, that claim shall proceed in the applicable forum and the remaining provisions of this Section 12 shall remain in full force.

12.3 Small Claims Court.

Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within that court's then-current jurisdictional limits, provided that such action remains in small claims court and is not removed or transferred to another court.

12.4 Equitable Relief.

Nothing in this Section 12 limits BTP's right to seek emergency or preliminary injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights, confidential information, or platform integrity pending resolution of any dispute.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

14. Entire Agreement

These Terms, together with our Privacy Policy (available at https://www.bulletprooftestprep.com/legal/privacy-policy) and any other legal notices published on our website, constitute the entire agreement between you and Bulletproof Test Prep regarding your use of our services.
